A Habitats Regulations Assessment (HRA) is required where proposed works may have the potential to affect a European protected site, either directly or indirectly. This requirement arises under the Conservation of Habitats and Species Regulations and applies where development is located close to a designated site or where pathways for impact exist over greater distances, such as through air quality, hydrology or disturbance.
While the responsibility for undertaking an HRA sits with the competent authority, it is common practice for applicants to commission a shadow HRA to provide the information needed to inform the authority’s assessment. In many cases, the competent authority will adopt the shadow HRA in full, allowing the planning process to progress more efficiently.
An HRA follows a staged process. The first stage is screening, which considers whether the proposed works are likely to have a significant effect on a European site, either alone or in combination with other plans or projects. Where likely significant effects cannot be ruled out, the assessment progresses to Appropriate Assessment, which examines whether the proposals would adversely affect the integrity of the site, taking account of proposed mitigation measures.
